Privacy Policy

Who we are

This Privacy Policy explains how Aviate-AR Inc. (“Aviate-AR”, “we”, “us”), a Delaware corporation at 1207 Delaware Ave #4799, Wilmington, DE 19806, USA, collects and uses personal data when you visit www.aviate-ar.com, join our waitlist, contact us, or use the Aviate-AR app and related services (the “Service”).

We are the controller of your personal data. For any privacy question or request, email eyes-outside@aviate-ar.com.

The short version: we collect only what we need to run the Service and talk to you, we do not sell your personal data, and you can ask us to see, correct or delete it at any time.

What we collect

Waitlist and contact
Your name, email address and anything you choose to tell us, such as your aircraft type, home airfield, EFB or whether you are a flight school or EFB vendor.

Account data
Name, email address, login credentials, pilot or organisation details and your settings.

Flight Data
When you use the app: GPS position, altitude, ground speed, heading, aircraft attitude, route and nearby traffic received from your EFB or traffic app. This is location data and is needed for the app to work.

Device and usage data
Device and AR glasses model, operating system, app version, crash reports, performance data (such as frame rate and tracking accuracy) and which features you use.

Purchase data
Subscription plan, billing history and transaction IDs. Card details are handled by the app store or payment provider; we do not see or store your full card number.

Website data
IP address, browser type, pages visited and referring site, collected through server logs and any cookies described in Section 8.

Test programme data
If you take part in a prototype or beta test: feedback, test reports and, where you agree, recordings of the AR view.

We do not ask for special category data, such as health information. Please do not send us medical certificate details unless we specifically request them for a test programme.

How we use it and why

Under the GDPR we must have a legal basis for each use. Ours are:

  • To provide the Service — run your account, process Flight Data to draw overlays, deliver updates and support. Basis: performance of our contract with you.
  • To manage the waitlist and answer you — send launch news and early-access invitations, and reply to enquiries. Basis: your consent, which you can withdraw at any time, and our legitimate interest in responding to you.
  • To keep the Service safe and working — diagnose crashes, fix bugs, prevent misuse and secure our systems. Basis: legitimate interests.
  • To improve the product — analyse usage and performance, mostly in aggregated or de-identified form. Basis: legitimate interests.
  • To handle payments and records — billing, tax and accounting. Basis: contract and legal obligation.
  • Marketing emails — only where you have opted in, or where the law allows us to email existing customers about similar products. Every email has an unsubscribe link. Basis: consent or legitimate interests.
  • Legal compliance — respond to lawful requests and protect our rights. Basis: legal obligation and legitimate interests.

We do not use your personal data for automated decisions that have legal or similarly significant effects on you.

Flight and location data

Flight Data is the most sensitive information we handle, so we treat it carefully:

  1. Processed for display. Flight Data is used in real time to draw airspace, traffic and HUD overlays. Where possible, this happens on your device or glasses.
  2. Uploaded only when needed. We upload Flight Data only to provide a feature you use (such as saved flights or syncing), for crash diagnosis, or with your permission.
  3. Never sold. We do not sell Flight Data or share it with advertisers, insurers or authorities, except where the law requires us to.
  4. Under your control. You can turn off location access in your device settings at any time, but the app’s navigation features will stop working.

Traffic information comes from your EFB or a traffic app such as SafeSky. If those apps share your own position with other pilots, that happens under their privacy policies, not ours.

Who we share it with

We share personal data only with:

  • Service providers who work for us under contract and only on our instructions: website hosting, form handling for the waitlist (Formspree), email delivery, cloud storage, crash reporting and customer support tools.
  • App stores and payment providers (such as Apple and Google) when you buy a Subscription.
  • EFB and integration partners you choose to connect, only for the data needed for that connection to work.
  • Professional advisers, such as lawyers and accountants, under confidentiality duties.
  • Authorities when the law requires it, or to protect the safety, rights or property of you, us or others.
  • A buyer or successor if Aviate-AR is involved in a merger, acquisition or sale of assets. We will tell you before your data becomes subject to a different privacy policy.

We do not sell or “share” your personal data for cross-context behavioural advertising, as those terms are defined in US state privacy laws.

International transfers

Aviate-AR is a US company, and some of our service providers are in the US and other countries outside the European Economic Area (EEA) and UK. When we transfer personal data out of the EEA or UK, we use a recognised safeguard, such as the European Commission’s Standard Contractual Clauses (and the UK addendum), or a provider certified under the EU-US Data Privacy Framework. You can ask us for a copy of the safeguards we use.

How long we keep it

Waitlist
Until launch plus 12 months, or until you unsubscribe or ask us to delete it, if sooner.

Account data
While your account is open, and up to 90 days after you close it.

Flight Data
Uploaded flights are kept until you delete them or close your account. Diagnostic data is kept for up to 12 months.

Purchase records
As long as tax and accounting laws require, typically 7 years.

Support emails
Up to 3 years after the conversation ends.

Server logs
Up to 90 days.

Cookies and similar technologies

Our website uses cookies that are strictly necessary for it to work, such as security and load-balancing cookies. We load web fonts from Google Fonts, which means your browser connects to Google’s servers and shares your IP address with Google.

If we add analytics or marketing cookies, we will ask for your consent first through a cookie banner where the law requires it, and you can change your choice at any time. [List any analytics or marketing tools here before publishing, or confirm none are used.]

Your rights

Depending on where you live, you have the right to:

  • access the personal data we hold about you and get a copy;
  • correct inaccurate or incomplete data;
  • delete your data;
  • restrict or object to how we use it, including objecting to direct marketing at any time;
  • receive your data in a portable format and have it sent to another provider;
  • withdraw consent at any time, without affecting earlier use;
  • opt out of the sale or sharing of personal data and of targeted advertising (we do neither);
  • not be discriminated against for using these rights.

To use any of these rights, email eyes-outside@aviate-ar.com. We will reply within one month (or 45 days where US state law applies), and may need to confirm your identity first. You can appoint an authorised agent to make a request for you.

If you are in the EEA or UK, you can also complain to your local data protection authority, such as the Dutch Autoriteit Persoonsgegevens or the UK Information Commissioner’s Office. We would appreciate the chance to resolve your concern first.

Security

We use technical and organisational measures to protect personal data, including encryption in transit, access controls and limiting access to staff and providers who need it. No system is completely secure. If a breach affects your personal data, we will notify you and the relevant authorities where the law requires.

Children

The Service is not directed at children under 16. Student pilots under 18 may use the Service only through a flight school or instructor, as set out in our Terms of Service. We do not knowingly collect personal data from children under 16 without parental or flight school consent. If you believe we have, contact us and we will delete it.

Changes to this policy

We may update this Privacy Policy as the Service develops. We will post the new version here and change the “Last updated” date. For material changes, we will also tell you by email or in the app before they take effect.
